SB 897: ADU Law on the Move

Why is SB 897 important?

There are still a number of obstacles that hinder homeowners who are interested in building ADUs, including financial constraints and owner-occupancy requirements that will be back in effect in 2025. SB 897 builds upon previous ADU legislation by addressing the remaining barriers to ADU construction and supporting the development of housing that is more affordable by design.

Highlights of the bill:

  • SB 897 will delete the 2025 sunset date in the current statute, which prohibits a local agency from imposing an owner-occupant requirement so that there is no owner-occupancy requirement for ADUs and Junior ADUs. 

  • The bill will also prohibit a local agency from denying a permit for an unpermitted ADU because of a  building standard violation unless it is a  health and safety violation. 

  • Furthermore, the bill proposes grant funding for the construction of ADUs. It also specifies that the construction of an accessory dwelling unit does not trigger a  requirement that fire sprinklers be installed in either the ADU or primary dwelling.
